What is a LMIA – Labour Market Impact Assessment?

LMIA (short for Labour Market Impact Assessment) is a labour market verification process whereby Employment and Social Development Canada (ESDC) assesses an offer of employment to ensure that the employment of a temporary foreign worker will not have a negative impact on the Canadian labour market.

Employers are required to do to extensive advertising for a minimum of four weeks to ensure Canadians have first access to available jobs. Employers also need to provide a variety of information about the position for which they want to hire a temporary foreign worker, including the number of Canadians who applied for the position, the number of Canadians who were interviewed, and detailed explanations for why the Canadian workers considered were not hired

How does it work?

Who needs to apply for an LMIA?

Employers who want to hire a local or overseas caregiver/temporary foreign worker (TFW) must submit the Labor Market Impact Assessment (LMIA) application along with all the required supporting documentation to Employment and Social Development Canada (ESDC)/Service Canada. In essence, employers are applying for an opinion on the impact that hiring a TFW would have on Canada's job market. Employers are required to advertise the position to ensure Canadians have first access to available jobs.

What happens next, once a positive LMIA is issued?

Once a positive LMIA has been issued, it must be forwarded to the caregiver – local or overseas – to enable them to obtain a visa and/or a work permit that will allow them entry to the country with the rights and obligations of any other worker. Does a caregiver/temporary foreign worker, in Canada, require an LMIA ?

A caregiver/temporary foreign worker, who is already in Canada, will also require a new LMIA  when changing employers. The caregiver  must additionally submit a work permit renewal application before her work permit expires. If you're employing a caregiver you must also file a new LMIA in order for your caregiver to renew her work permit.
